Important: This End User License Agreement (this "Agreement") is a legally binding agreement between you ("you" or "User") and the developer and operator of EchoLing AI ("EchoLing AI", "we", "us", or "our") governing your download, installation, sign-in, and use of the EchoLing AI desktop application for Windows (the "Software") and the related services. By creating an account, signing in, installing, or otherwise using the Software, you confirm that you have read, understood, and agree to be bound by this Agreement. If you do not agree to any part of this Agreement, do not install or use the Software.
1.1 "Software" means the EchoLing AI real-time voice translation desktop application for Windows, together with its components, documentation, updates, and upgrades.
1.2 "Service" means the account, billing, and translation features made available through the Software, including real-time speech translation powered by the Google Gemini API.
1.3 "Minutes" means units of translation usage time deducted from your account balance while a translation session is running.
1.4 The Software is designed to provide real-time, two-way voice translation in third-party calling and meeting applications by means of a virtual microphone (VB-Cable) and system audio loopback capture.
2.1 License, not sale. The Software is licensed, not sold. Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Software on devices you own or control, for your personal or internal business use.
2.2 All rights not expressly granted in this Agreement are reserved by us and our licensors. You acquire no ownership interest in the Software.
3.1 Use of the Service requires an account. You sign in with your email address and a one-time verification code; no password is stored. You must provide a valid email address that you control.
3.2 You are responsible for maintaining the security of your email account and for all activity that occurs under your EchoLing AI account.
3.3 Minutes are purchased; new accounts begin with a zero balance. Interpretation requires a positive Minute balance.
4.1 Minute-based usage. Translation usage is billed by the minute. While a translation session is active, Minutes are deducted from your account balance; when you stop the session, deduction stops.
4.2 Purchases. Subscriptions and minute packs are sold through Paddle, acting as Merchant of Record. Your purchase is also subject to Paddle's checkout terms. We do not collect or store your full payment card details.
4.3 Pricing. Prices displayed before launch are early-bird prices and are subject to change. The price applicable to your purchase is the price displayed at checkout at the time of purchase.
4.4 Subscriptions. Paid subscriptions renew automatically at the end of each billing period unless cancelled before renewal. You can cancel at any time; cancellation takes effect at the end of the current billing period.
4.5 Refunds. Purchases are generally non-refundable once the corresponding Service has been consumed, except where a refund is required by applicable consumer protection law or granted at our discretion. Refund requests should be sent to contact@echolingai.com and will be processed together with Paddle. Nothing in this Agreement limits your non-waivable statutory rights, including (where applicable) withdrawal rights under EU/UK consumer law.
5.1 You must use the Software only for lawful purposes and in compliance with the laws applicable to you and to the other participants of your calls.
5.2 Recording and consent. The Software can save subtitle history and, if you enable it, audio recordings of your sessions — locally on your device. Laws on recording and monitoring conversations differ by jurisdiction and may require the consent of all participants. You are solely responsible for obtaining any legally required consent before recording or transcribing a conversation.
5.3 You must not: (a) intercept, monitor, or record communications unlawfully; (b) infringe the privacy, publicity, intellectual property, or other rights of any person; (c) use the Software for fraud, harassment, or any unlawful activity; (d) reverse engineer, decompile, disassemble, or circumvent license or billing controls of the Software, except to the extent such restriction is prohibited by applicable law; (e) resell, rent, lease, share, or sublicense your account or the Service; or (f) interfere with or disrupt the Service or attempt to access it by automated means in a manner that exceeds normal use.
5.4 We may suspend or terminate accounts that violate this Section. Where the violation is material, consumed Minutes and fees are non-refundable to the extent permitted by law.
6.1 Google Gemini. Real-time translation is performed by the Google Gemini API (gemini-3.5-live-translate). Audio from your sessions is streamed to Google for processing as described in our Privacy Policy. The availability and quality of the underlying model service depend on Google.
6.2 VB-Cable. The Software relies on the VB-Cable virtual audio device, a third-party component installed under its own license terms.
6.3 Calling apps. Zoom, Microsoft Teams, Google Meet, Discord, and other calling software are independent third-party products. We do not control them and are not responsible for their behavior, and references to them do not imply endorsement or affiliation.
6.4 Paddle. Payments are processed by Paddle as Merchant of Record under Paddle's own terms and privacy policy.
7.1 Translations and synthesized speech produced by the Software are generated by artificial intelligence, not by human interpreters. AI output may contain errors, omissions, or ambiguities and may not fully reflect the speaker's intent.
7.2 You must not rely on the Software as the sole basis for decisions in legal, medical, financial, safety-critical, or other high-stakes contexts. For such situations, use qualified human interpretation or verification. See our AI Disclosure for details.
8.1 Our collection and use of personal data is described in the EchoLing AI Privacy Policy. In short: account and usage data (email address, Minute balance and usage) are processed on our systems; call audio is streamed directly to the Google Gemini API for real-time translation and is not stored on our servers; subtitle history and recordings are stored only on your device.
9.1 The Software, including its code, design, text, graphics, and the EchoLing AI name and logo, is owned by us or our licensors and protected by intellectual property laws.
9.2 You may not remove or alter any proprietary notices in the Software. We claim no ownership of the content of your conversations.
10.1 To the maximum extent permitted by applicable law, the Software and Service are provided "AS IS" and "AS AVAILABLE", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy of translation, and non-infringement.
10.2 We do not warrant that the Service will be uninterrupted, timely, or error-free, or that translations will be accurate or complete. Interruptions may result from third-party services (including Google and network providers), your hardware or network, or maintenance.
10.3 Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions, the above exclusions apply to the maximum extent permitted, and consumers retain all rights granted by mandatory law.
11.1 To the maximum extent permitted by applicable law: (a) we will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profits, business, goodwill, or data; and (b) our total aggregate liability arising out of or relating to the Software or this Agreement will not exceed the amounts you paid to us for the Service in the twelve (12) months preceding the event giving rise to the claim.
11.2 Nothing in this Agreement excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud or willful misconduct.
12.1 You may stop using the Software and delete your account at any time by contacting contact@echolingai.com.
12.2 We may suspend or terminate your license and account if you materially breach this Agreement, if required by law, or if we discontinue the Service. If we discontinue the Service, we will provide reasonable advance notice where practicable and, where required by law, a pro-rata refund of prepaid amounts for the unexpired period.
12.3 Sections that by their nature should survive termination (including Sections 7, 9, 10, 11, and 13) survive termination.
13.1 We may update this Agreement from time to time. Material changes will be announced in the Software or on echolingai.com before they take effect. Your continued use of the Software after the effective date of an updated Agreement constitutes acceptance of the changes.
13.2 This Agreement is governed by the laws of the jurisdiction in which the operator of EchoLing AI is established, without regard to its conflict of laws rules — provided that, if you are a consumer, you also retain the protection of any mandatory provisions of the law of your country of residence, and nothing in this clause deprives you of the right to bring proceedings in your local courts where applicable law grants it.
13.3 If any provision of this Agreement is found invalid or unenforceable, the remaining provisions remain in full force and effect.
